Disrespecting the Disrespected

Kleinheider had a nice little find over at Volunteer Voters, about a Judge in Blount County, Dale Young, who urged a legal immigrant to go back to where she came from, rather than seek a court order of protection against her husband:

Anna Calixto went to court Friday seeking an order of protection from her husband, Fernando Calixto. Instead, she was told to go back to her native country of Nicaragua by Blount County Circuit Court Judge W. Dale Young, according to witnesses...

...“When the judge asked if I was here legally,” Anna Calixto said, “I told him I have my temporary worker permit and I have the documentation showing it from the immigration service."

“The judge shrugged his shoulders like he didn’t care — then he told me to go back to Nicaragua."

“I told him I have two children and asked what I was supposed to do about my children. The judge said there were Americans here in this country who could take care of my children."

While the ignorance of this goes without saying, it is all the more surprising, because Judge Dale Young, a Former member of the Blount County Republican Executive Committee, seemed to think victims of domestic violence should be treated with respect back when he was running for re-election in 2006. Via a LWV Questionnaire:

Orders of Protection presently authorized by law give any law officer the right and duty to arrest an offender without warrant upon being notified by the protected party that a violation has occurred. The offender is incarcerated subject to the further orders of the Court. This is a valuable tool in ensuring the safety of the victim and sends a message to the offender that consequences result from criminal action...

...Those who are the victims of domestic violence are due the same respect and thoughtful consideration that any other litigant who has a case before the Court.

Wow, if this is the level of respect he shows for victims of domestic violence, it must suck to be a litigant in his court.

There's something that can be done about Judges like this one, but we shouldn't write it in public.

Maybe we should let a womens self defense class loose on him... I have a feeling a few good kicks to the chest or crotchitorial (MY WORD... I OWN IT... =P) region would cause him to change his tune on any domestic violence case.

technically he could be removed for denying an Immigrant Worker the same rights as a naturalized citizen, right?

I really hate being from Tennessee sometimes... too much ignorance hidden in closets.

Has anyone who has posted a comment actually read the statute concerning orders of protection in conjunction with the acts Ms. Calixto complained of? She was not entitled an o.p. on the basis of the statute. Requesting visitation and unauthorized use of a debit card is not domestic violence.

The local spin machine is fast at work. When they could not confuse the issue of Mrs. Calixto being here legally, they turned to defining their verisons of what domestic abuse is.

I've been a litigant in Dale Young's courtroom for going on 10 years now - and yes, it does stink as in fishy, smelly, and rotten to the good-ole-boy core. His rulings toward me and my children would curl your hair. We are not one of the stories that will be published in the newspaper though because I desire to protect my children's privacy. But, after hearing the other women's stories, I am not afraid anymore. In fact, I'm currently preparing a statement for Mr. Young of all the counseling expenses my children have incurred over the years as a direct result of him doing absolutely NOTHING TO PROTECT THEM FROM THEIR ABUSIVE FATHER WHEN HE COULD HAVE TAKEN ACTION YEARS AGO! When I became too intimidated, weary and poor to fight it out in court anymore I put my time, energy and money into getting professional help for my children. It's been rough but we survived the Blount County good-ole-boy system and YES, IT DOES EXIT! Shame on you, Dale Young - you are NO judge in my book. What goes around is about to come around for you. Or, to put it in biblical terms, you are about to reap what you've sewn. May God have mercy.
